3. SMS Terms of Service

The following SMS Terms of Service apply to any SMS messages you may receive from TWIY Health in connection with our healthcare case intake coordination services.

SMS Consent Communication: The phone numbers obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.

4. Limitation of Liability

To the maximum extent permitted by applicable law, TWIY Health and its officers, employees, contractors, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

In all cases, TWIY Health’s total aggregate liability for any claim arising out of or relating to these Terms & Conditions or our services will be limited to the amount you have paid to TWIY Health for the services giving rise to the claim, if any, in the twelve (12) months preceding the event giving rise to the claim.

5. Governing Law (United States)

These Terms & Conditions, and any dispute or claim arising out of or relating to them or to your use of TWIY Health’s services, will be governed by and construed in accordance with the laws of the United States and, to the extent applicable, the laws of the state in which TWIY Health is primarily organized, without giving effect to any conflict of law principles.

Any legal action or proceeding arising under or relating to these Terms & Conditions will be brought exclusively in the state or federal courts located within the United States jurisdiction where TWIY Health maintains its principal business operations, and you consent to the personal jurisdiction and venue of such courts.
